Terms of Service
These Terms of Service ("Terms") govern your use of the Tempo iOS application ("Tempo", "the App"), operated by Fernan Ochoa ("we", "our", "us"). By downloading, installing, or using Tempo, you agree to these Terms. If you do not agree, please do not use the App.
1. The Service
Tempo is an AI-assisted calendar and planning application for iOS. It uses voice input and artificial intelligence to help you schedule tasks and events in your Apple Calendar. Tempo is provided as-is and is intended to assist, not replace, your own judgment about how to plan your day.
2. Eligibility
You must be at least 13 years old to use Tempo. By using the App, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.
3. Your Apple ID & Calendar
Tempo reads from and writes to your Apple Calendar via Apple's EventKit framework, with your explicit permission. You are responsible for maintaining the accuracy of your own calendar data. Tempo does not back up, restore, or otherwise manage your calendar data outside of what you directly confirm in the App.
4. Subscriptions & Billing
Tempo offers optional paid subscriptions to unlock certain features. Current subscription options include:
- Monthly subscription — includes a 7-day free trial for new subscribers.
- Annual subscription — billed once per year.
All subscriptions are processed through the Apple App Store. Payment will be charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
You can manage and cancel your subscription at any time from your Apple ID account settings. Any unused portion of a free trial is forfeited when you purchase a subscription.
5. Refunds
All purchases are processed by Apple and are subject to Apple's refund policy. We cannot issue refunds directly. You may request a refund through Apple at reportaproblem.apple.com.
6. AI-Generated Content
Tempo uses artificial intelligence (Google Vertex AI / Gemini) to suggest schedules. AI-generated suggestions may contain errors, misinterpret your input, or produce results that do not match your expectations. You are always in control: Tempo shows you a preview before writing to your calendar, and you may edit or reject any suggestion. You agree that you are responsible for reviewing AI suggestions before confirming them.
7. Acceptable Use
You agree not to:
- Use Tempo for any unlawful purpose.
- Reverse engineer, decompile, or attempt to extract source code from the App.
- Submit content designed to abuse, overload, or bypass the AI backend.
- Use the App to impersonate another person or misrepresent your affiliation with any entity.
8. Disclaimer of Warranties
Tempo is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the App will be uninterrupted, error-free, or that AI suggestions will be accurate, complete, or appropriate for your needs. Tempo is not a substitute for medical, psychological, or professional advice.
9. Limitation of Liability
To the fullest extent permitted by law, in no event shall Fernan Ochoa, its affiliates, or contributors be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of Tempo, including but not limited to missed appointments, lost productivity, or corrupted calendar data. Our total liability for any claim shall not exceed the amount you paid for the subscription in the twelve months preceding the claim.
10. Third-Party Services
Tempo relies on third-party services including Apple (iOS, App Store, EventKit, Speech), Google Firebase and Vertex AI, and RevenueCat. Your use of these services through Tempo is also governed by their respective terms of service.
11. Changes to the Service
We may modify, suspend, or discontinue any part of Tempo at any time, with or without notice. We are not liable to you or any third party for any such modification, suspension, or discontinuation.
12. Changes to These Terms
We may update these Terms from time to time. Material changes will be posted here with a revised "Last updated" date. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.
13. Termination
We may terminate or suspend your access to Tempo if you violate these Terms. You may terminate your use at any time by uninstalling the App and cancelling your subscription.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Spain, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of Tempo shall be resolved in the courts of Spain.
